New Books: Cruel & Unusual

In the new book Cruel & Unusual: the American Death Penalty and the Founders’ Eighth Amendment, author John D. Bessler explores the the Founders’ views of capital punishment and the influence of the Enlightment on their approach in the Eighth Amendment.  Following a critique of the case law from the Supreme Court, the author argues that the death penalty should be found unconstitutional.

From the philosophical to the practical, the new book Anatomy of Injustice: a Murder Case Gone Wrong by Raymond Bonner explores a mishandled South Carolina murder case that left an innocent man facing execution and looks at how racism, prosecutorial misconduct, and inept defense lawyers bring about injustice in courtrooms across the country.
